Terms of Service
Version 1 · In force from 22 September 2026 · Last updated 22 September 2026
Key points
A summary of the terms most likely to matter to you. It does not replace the full text, and each point links to the section it comes from.
- Included tokens expire every month. Your plan's monthly allowance is granted for a calendar month (UTC) and anything left is cleared at the start of the next one. Purchased top-up tokens do not expire. See how tokens work.
- AI output is not checked by us. Generated copy and images can be wrong, and you are responsible for what you publish. See AI features.
- Feed URLs are public. A feed export link works for anyone who has it, with no sign-in. See public feed URLs.
- Our liability is limited, and for business customers we exclude some losses altogether. Nothing limits a consumer's statutory rights. See liability.
- We can suspend an account for unpaid fees, prohibited use or a legal requirement. See suspension and termination.
1. Who we are
Curate is a service operated by CURATE STUDIO TECHNOLOGIES LIMITED, a company registered in England and Wales (company number 17503767), registered office TODO(legal): registered office address, trading address TODO(legal): trading address. Our VAT number is TODO(legal): VAT number, or state not VAT registered.
You can reach us at chris@curatestudio.dev. In these Terms, “we”, “us” and “our” mean CURATE STUDIO TECHNOLOGIES LIMITED, and “you” means the person or organisation using Curate.
2. These Terms and how the contract is made
These Terms apply when you create an account and use Curate. You agree to them by clicking the button that says you agree — closing or ignoring the prompt is not agreement, and we do not treat it as agreement. Until you have agreed, you can still sign in, open your projects and export your data; AI features, rendering and buying a plan are unavailable.
When you buy a plan, the steps are: choose a plan, enter payment details, confirm the purchase, and receive a confirmation by email. You can correct mistakes before you confirm by going back a step in the checkout. A contract is formed when we confirm the purchase.
You can read the current version at any time at /terms, print or save it as a PDF from the button at the top of the page, and read superseded versions at /terms/v/1, /terms/v/2 and so on. We will also send you the version in force when you buy a plan. These Terms are available in English only.
Our Privacy Policy and Cookie and Storage Policy are information about how Curate works, not terms you agree to. Reading them is separate from agreeing to these Terms.
3. Eligibility and your account
- You must be at least 18 to use Curate.
- Authentication is provided by Clerk. Keep your sign-in details to yourself; you are responsible for what happens under your account.
- If you use Curate for an organisation, you confirm you are allowed to accept these Terms for that organisation, and “you” then means both you and it.
- One person or organisation per account. Sharing one account between separate businesses is not allowed, because credit allowances, saved templates and uploaded assets are scoped to a single account.
4. Curate is in beta
Curate is still in beta. Features change, some are incomplete, and there will be faults. Two consequences you should plan for:
- Keep your own copy of anything you cannot afford to lose. Curate is a tool for producing images and feeds from your product data, not a system of record for that data.
- We may change, restrict or remove features. Where a change materially reduces what you have paid for, section 20 applies.
None of this affects a consumer's statutory right to a service carried out with reasonable care and skill.
5. Plans, tokens and payment
Curate is sold as a subscription, billed monthly or, where an annual price is offered, annually. Each plan includes a monthly allowance of tokens, which is what AI features and rendering are charged against — the allowance is monthly however you are billed. Current plans, prices and allowances are shown on the billing page and at the pricing section of our home page.
- Billing. Subscriptions are handled by Clerk Billing, with payments taken by Stripe. We never see or store your card details.
- Prices. Prices are shown in US dollars. TODO(legal): state whether prices include VAT, and for which customers.
- Renewal. A subscription renews at the end of each billing period until you cancel it. You can cancel at any time from the billing page or your account profile; the plan then runs to the end of the period you have paid for and is not renewed.
- One-time token packs are not on sale at the moment. Where they are offered, the tokens are added on payment and do not expire.
- Changing plan. You can change plan at any time. Clerk prorates the charge. Changing plan also re-grants tokens — see section 6.
- Unpaid fees. If a payment fails we may limit or suspend paid features until it is settled.
- Free plan. There is a free monthly allowance so you can try Curate. It behaves like a paid allowance in every respect described below.
6. How tokens are granted, expire and are spent
This section describes exactly what the software does, because token expiry is the term most likely to cost you something unexpectedly.
- Tokens are a usage allowance, not money. They have no cash value, cannot be transferred or sold, and cannot be exchanged for anything other than use of Curate.
- Included tokens are granted per calendar month. Your plan's allowance is granted once for each calendar month, measured in UTC — not from the date you subscribed. It expires at the start of the following month (00:00 UTC on the 1st).
- Unused included tokens do not roll over. When the next month's allowance is granted, any included tokens left from the previous grant are cleared. If you subscribe part-way through a month you still receive that month's full allowance, and it still expires at the start of the next month.
- Changing plan re-grants. Moving to a different plan part-way through a month grants that plan's full monthly allowance immediately, and clears the included tokens remaining from the plan you left.
- Purchased and bonus tokens never expire. Top-up tokens, sign-up bonus tokens and tokens we return to you after a failed run stay on your account until you spend them, or until the account is deleted.
- Spending order. Tokens are spent soonest-expiring first, so your monthly allowance is always used before tokens that do not expire.
- Costs. Each AI or rendering action costs a set number of tokens per item — per row, per image, or per second of video — shown in the app before you run it. Costs can change; a change applies to actions you run after it takes effect.
- Failed runs. Tokens are taken before the work runs. Where a run fails after we have taken tokens and the fault is ours, we return the tokens as non-expiring credit. If a run fails because of the content you supplied — an unreadable file, an image we cannot fetch — the tokens are not returned.
- Fair use. There are per-request ceilings on rows and images and a per-account request rate limit, to keep the service working for everyone. They are set well above normal use and we will tell you if you hit one.
7. Your right to cancel (consumers)
This section applies if you are buying as a consumer — that is, for purposes mainly outside a business. It sets out rights you have under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 and, in the EU/EEA, Directive 2011/83/EU.
The 14-day period
You can cancel a subscription or a token purchase within 14 days, starting the day after the contract is made, without giving a reason.
TODO(legal): confirm whether each product is a service or digital content — the two have different rules on when the right is lost, and the wording below assumes a service.
We do not start supplying a paid plan inside those 14 days unless you expressly ask us to. In the app that is the “Start my plan now” button; we record that you asked, and when. Until you ask, purchased tokens sit on your account and cannot be spent, and if you then cancel you pay nothing.
What you pay if you cancel after asking us to start
If you asked us to start and then cancel inside the 14 days, you pay a proportionate amount for what was actually supplied. We work that out as follows.
- Subscriptions: the higher of (a) the share of the month that has passed — days elapsed divided by days in the month, times the monthly price — and (b) the share of the allowance you have spent — tokens spent divided by the month's allowance, times the monthly price. Capped at the monthly price. We use the higher of the two because either measure on its own can understate what we have provided.
- Token top-ups: the tokens you have spent from the pack, times the pack price divided by the tokens in the pack.
You lose the right to cancel once the service has been fully provided, where you asked us to start inside the 14 days and acknowledged that you would lose it. For a subscription, that means once the paid month has run in full.
We refund the rest within 14 days of being told you are cancelling, using the same payment method you paid with.
How to cancel
Use the Withdraw from contract here button on the billing page. It is available for 14 days after a purchase, we acknowledge it by email, and it is the quickest route. You do not have to use it: any clear statement that you are cancelling is enough, by email to chris@curatestudio.dev or by post to TODO(legal): trading address. You can use the form below, but you do not have to.
Cancelling a contract under this section is not the same as cancelling a subscription so it does not renew, which you can do at any time from the billing page. Monthly renewals and monthly token grants are not new contracts and do not start a new 14-day period.
8. Your content
Your content — product feeds, images, fonts, designs imported from Figma, templates and anything else you put into Curate — stays yours. We claim no ownership of it.
You give us a licence to host, copy, store, adapt, transmit and display your content, and to send it to the providers listed in our Privacy Policy, only so far as is needed to run the service for you: to render images and video, to generate copy and templates, to publish the feeds you ask us to publish, and to back up and restore your work. The licence lasts while your content is on Curate and ends when you delete it or your account, apart from copies in ordinary backups, which age out.
We do not use your content to train AI models, and we do not licence it to anyone else. You confirm you have the rights to the content you upload, including any font licence that covers using the font to produce images.
9. Acceptable use
Do not use Curate to:
- break the law, or infringe someone else's rights, including copyright and trade marks;
- produce or publish illegal content, material that sexualises children, or content that harasses, defames or incites violence against people;
- upload someone else's personal data without a lawful basis, or special category data such as health data, into product feeds;
- impersonate a brand you are not authorised to represent, or produce advertising that is misleading about a product, price or availability;
- probe, scrape or overload the service, get round rate limits or token costs, or use another account to do what your own is blocked from doing;
- resell access to Curate, or expose our AI features as a service of your own.
10. AI features and output
Several features use AI models supplied by third parties: rewriting product copy, suggesting and generating templates, editing or generating images, removing backgrounds and suggesting how a Figma design maps to your data. What each one sends is set out in our Privacy Policy.
- Output is generated automatically and is not reviewed by us. It can be factually wrong, repetitive or unsuitable, and the same input will not always give the same output.
- Check output before you publish it — particularly prices, sizes, claims about a product, and anything that has to be accurate by law.
- We make no promise that output is unique, or that it does not resemble output given to someone else.
- As between you and us, output generated for you is yours to use. We cannot promise it is free of third-party rights, because that depends on the model and your input.
- Providers may refuse a request under their own policies. That still costs tokens where the request reached them.
11. Public feed URLs
The feed export feature publishes your finished rows at a fixed URL so Google Merchant Center, Meta and similar systems can fetch them. Please read this before you publish a feed:
- The URL is public. It needs no sign-in. Anyone who has the link can read the feed — product data, prices, and the links to your rendered images. The link is a long random token, which makes it impractical to guess, but it is the only protection.
- The URL does not change when the feed updates, which is what lets a shopping platform keep fetching it.
- Do not put personal data or anything confidential in a feed you publish.
- There is no way to rotate a feed token in the app yet. Email chris@curatestudio.dev and we will delete the endpoint, which stops the URL working.
12. Availability and support
We aim to keep Curate available but we do not promise a particular uptime, and we may take it down for maintenance. There is no guaranteed response time for support; email chris@curatestudio.dev and we will answer as soon as we reasonably can.
13. Suspension and termination
You can stop using Curate at any time. We may suspend or limit your account, or end this contract, if:
- you materially break these Terms, in particular section 9;
- a payment is unpaid after we have asked you to settle it;
- we have to, to comply with the law or a court or regulator; or
- your use is causing a security or stability problem for other users.
Where it is practical and lawful to do so, we tell you first and give you a chance to put things right. A suspension is limited to what the problem requires: we will not withhold access to your existing content and exports where the problem does not concern it. If we end this contract and you have not broken these Terms, we refund the part of your current month you have not used and any unspent tokens you paid for.
14. Deleting your account
You can delete your account from your account profile. When you do, we delete your projects, templates, layouts, uploaded assets, imported Figma assets and published feed endpoints, and remove the uploaded files behind them. We keep our records of payments, token grants and spending, your acceptances of these Terms, consent records and any cancellation you submitted, because we need them to meet our legal and accounting duties and to defend legal claims. This is explained in the Privacy Policy.
Deleting your account forfeits any tokens left on it, including purchased tokens, and cancels nothing on its own — cancel your subscription separately. If you are a consumer and had purchased tokens you had not spent, email chris@curatestudio.dev and we will refund them.
15. Data protection
Where we handle personal data about you — your account, your billing, your use of the service — we are the controller, and the Privacy Policy explains what we do.
Where you upload personal data about other people, for example in a product feed or a customer image, you are the controller and we act as your processor. In that case the schedule in section 16 forms part of this contract and satisfies Article 28(3) UK GDPR and EU GDPR.
16. Data processing schedule (business customers)
- Subject matter and duration
- Processing of the personal data you put into Curate, for as long as your account holds it, and afterwards only as described under “Return and deletion” below.
- Nature and purpose
- Storing, parsing, transforming and rendering the data you supply into images, video and product feeds; sending it to the AI providers you invoke; hosting the outputs and the feed URLs you publish; and giving you support when you ask for it.
- Types of personal data
- Whatever your feeds, images and prompts contain. Curate is built for product data, which does not usually need personal data, and we ask you not to include special category data.
- Categories of data subject
- Determined by you — typically your own staff and, where your content includes them, your customers or the people pictured in your images.
We will:
- process the data only on your documented instructions, which these Terms and your use of the features are;
- keep it confidential and make sure the people who handle it are bound to confidentiality;
- apply appropriate technical and organisational measures: transport encryption, encryption at rest with our hosting and database providers, authentication and per-account authorisation checks on every request, least-privilege access to production systems, and rate limiting;
- use sub-processors only as listed in the Privacy Policy. That list is your prior general authorisation. We will publish a change there at least 30 days before it takes effect, and you may object in that period by ending the affected part of the service, with a refund of the part you have paid for and not used;
- impose equivalent obligations on each sub-processor, and stay responsible to you for their performance;
- help you meet requests from data subjects and your obligations on security, breach notification, data protection impact assessments and prior consultation, so far as the data is only available to us;
- tell you without undue delay if we become aware of a personal data breach affecting your data, with the information you need to notify your regulator;
- on your instruction, delete or return the data at the end of the service, unless the law requires us to keep it. Deleting your account does this; you can also export your data at any time (see section 18);
- make available the information you need to demonstrate compliance with Article 28, and allow an audit or inspection, on reasonable notice, no more than once a year unless a regulator or a breach requires otherwise, subject to confidentiality;
- tell you if an instruction appears to us to breach data protection law.
Transfers outside the UK and EEA, and the safeguards used for them, are described in the Privacy Policy.
17. Reporting illegal content, and moderation
Curate hosts content you upload and, through feed URLs, content you publish. This section sets out our duties under the EU Digital Services Act and how we handle reports.
- Reporting illegal content. Email chris@curatestudio.dev with: an explanation of why you consider the content illegal; the exact URL, and any other information needed to locate it; your name and email address, unless the report concerns child sexual abuse material or certain other offences against a person; and a statement that you believe in good faith that the information in the report is accurate and complete. We confirm receipt without undue delay, decide in a timely, diligent, non-arbitrary and objective way, and tell you the outcome and how to challenge it.
- Contact point for users. chris@curatestudio.dev, by email, in English. We do not use an automated-only channel.
- Contact point for authorities. chris@curatestudio.dev. Our EU legal representative is TODO(legal): DSA Art 13 EU legal representative.
- What we may do. Remove or disable content, restrict a feed URL, or suspend an account. Where we act against your content or your account, we give you a statement of reasons: what we did and to what, the facts we relied on, whether automated means were used, the legal or contractual ground, and how to complain.
- Complaining about a decision. Email chris@curatestudio.dev within six months of being told. A person, not a system, reviews it, and we reverse the decision if it was wrong. You can also use a certified out-of-court dispute settlement body, or go to court.
- Misuse. We may suspend an account that repeatedly posts manifestly illegal content, or someone who repeatedly sends manifestly unfounded reports, after warning them.
18. Getting your data out, and switching provider
You can end this contract and move to another provider. These terms reflect Chapter VI of the EU Data Act.
- Notice. You may terminate with no more than two months' notice; in practice cancelling a monthly subscription takes effect at the end of the month you have paid for.
- Transition. We will complete the switch within 30 days of the notice period ending, and tell you if a complication makes that impossible.
- Retrieval window. Your data stays available to retrieve for at least 30 days after the service ends.
- What you can export. Your product rows and pipeline configuration as JSON; published feeds as CSV, TSV or JSON; rendered images and video; uploaded images and fonts, and imported Figma assets, as files; and saved templates and layouts as their stored JSON. An account-level export of everything at once is not built yet; until it is, export per project and ask us at chris@curatestudio.dev if you need help.
- What you cannot export. Our own template library and prompt engineering, our internal logs, and anything that would disclose our trade secrets or another customer's data.
- Erasure. After the retrieval window we delete your data as described in section 14.
- Charges. We do not charge for switching or for exporting your data. From 12 January 2027 no such charge is permitted in any event.
19. Liability
Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited by law.
If you are a consumer, nothing here affects your statutory rights. You are entitled to a service performed with reasonable care and skill, and to the remedies in the Consumer Rights Act 2015 — including sections 31, 49 and 57, which cannot be excluded — or the equivalent rights where you live. We are responsible for loss you suffer that is a foreseeable result of our breaking this contract or failing to use reasonable care and skill. We are not responsible for loss that was not foreseeable, or for business losses: if you use Curate for a business, the limits below apply instead.
If you are a business, then subject to the paragraph above:
- we exclude all liability for loss of profit, loss of sales or revenue, loss of business, business interruption, loss of anticipated savings, loss of goodwill, and any indirect or consequential loss;
- we exclude all liability for loss or corruption of your data, except that we remain liable for our own failure to take the security measures described in section 16;
- our total liability for all claims arising in any 12-month period is limited to the greater of the fees you paid us in that period and £100;
- we exclude all warranties, conditions and terms implied by statute or common law, to the extent permitted by law;
- we are not liable for the accuracy or suitability of AI output, or for anything you publish from Curate.
Neither of us is liable for a failure caused by something outside our reasonable control, for as long as it lasts.
20. Changes to these Terms
We may change these Terms for a valid reason, which includes:
- a change in the law, in regulatory guidance, or in a court decision that affects them;
- a change in the features Curate offers, or in the providers behind them;
- a change in our prices or token costs; or
- correcting an error, or making the wording clearer without changing its effect.
How a change happens:
- We email you at least 30 days before the new version takes effect, with a summary of what changed and a link to the new text. The version in force does not change until the effective date named in that email, even though the new text is published sooner.
- When you next sign in we ask you to agree to the new version. Until the effective date you can carry on as normal whether you have agreed or not.
- From the effective date, AI features, rendering and buying a plan need the new version. Your account, your content and exporting your data stay available either way.
- If you do not want to accept a change, you may end this contract before the effective date. We then refund any tokens you paid for and have not spent, plus the part of your current month you have not used, and you keep access until the refunded period ends.
- The previous version stays published at its archive URL so you can compare them.
21. Complaints
Email chris@curatestudio.dev and tell us what went wrong. We aim to acknowledge within five working days and to resolve it within 30 days. If we cannot settle it between us, and you are a consumer, you may use an alternative dispute resolution provider. TODO(legal): name the ADR provider, or state that we do not use one. Complaints about how we handle personal data are dealt with in the Privacy Policy.
22. Governing law
These Terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction — except that if you are a consumer, you keep the protection of the mandatory consumer law of the country you live in, and you may bring proceedings in your own country's courts.
23. Other terms
- These Terms, together with the Privacy Policy where it is referred to here, are the whole agreement between us about Curate.
- You may not transfer your rights under these Terms without our consent. We may transfer ours if the business is sold or reorganised; we will tell you, and it will not reduce your rights.
- If a provision is unenforceable, the rest stays in force.
- Not enforcing a term straight away does not mean we have given it up.
- No one other than you and us has any right to enforce these Terms.
